Elevate Nursing Academy Inc. owns and operates the website https://elevatenursingacademy.com/ and its associated mobile and web applications (collectively referred to as the “Website”). Elevate Nursing Academy Inc. is and shall remain committed to protecting the privacy and security of the personal information of its Website’s users (collectively referred to as the “Users” and individually, a “User”).
When used in this Privacy Policy, the terms “Elevate Nursing Academy”, or the “Academy” shall refer to Elevate Nursing Academy Inc.
This Privacy Policy shall detail how the Academy uses, stores and protects Users’ personal information. In addition, the present Privacy Policy shall set out the rights granted to Users in connection with their personal information.
- DEFINITIONS
Any capitalized terms not defined in this Privacy Policy shall have the meanings ascribed to them in the Academy’s Terms and Conditions (the “Terms and Conditions”), which shall be available for review on the Website.
When used in this Privacy Policy, “Non-Personal Information” shall refer to data that cannot be used to identify a User personally. Non-Personal Information may include but shall not be limited to anonymous usage statistics, demographic details and preferences.

By using the Website and/or providing Personal Information on the Website, Users consent to the collection, storage, protection, and disclosure of their Personal Information in accordance with this Privacy Policy. Users further agree to receive emails from the Academy as per the terms of this Privacy Policy. This Privacy Policy is specific to the Website and shall not extend to any third-party websites. Elevate Nursing Academy shall not be liable for how third parties collect, use, or manage Users’ Personal Information.

Such Personal Information may be provided during the User Account registration process or checkout, and may include but is not limited to the User’s valid email address, contact details, payment information, and any other relevant information.
Elevate Nursing Academy may also collect Personal Information shared by Users during customer support interactions, surveys, and other communications between Users and the Academy.
Additionally, the Academy will collect information related to purchases made by Users on the Website, such as Course and Module purchases. When Users complete a purchase on the Website, Users acknowledge that the Academy’s third-party payment processor may collect their payment information. Unless otherwise specified, the Academy shall not be granted access to or collect Users’ financial information.
The Academy may also collect Non-Personal Information, such browser information and time spent on the Website. Non-Personal Information cannot be used to identify any individual User of the Website.

5.1 User Accounts and Purchases
Elevate Nursing Academy may use Personal Information to communicate with a specific User, provide support, and respond to inquiries. As such, the Academy may use Personal Information to address any Users’ questions, support requests, and issues which relate to the Website.
Additionally, the Academy may use Personal Information to register and manage the User’s Account on the Website.
5.2 Course and Module Provision
Given the nature of the Website, the Academy may disclose Personal Information to process payments for Courses and Modules purchased through the Website and facilitate the provision thereon on the Learning Management System.

The Academy’s use of Personal Information shall be strictly limited to what is absolutely needed to fulfill the Academy’s legitimate business interests, in compliance with applicable data privacy laws.
The Academy may use Personal Information for business and commercial purposes as permitted under Canadian data privacy laws, which shall include, without limitation, Personal Information Protection and Electronic Documents Act (PIPEDA).
5.4 Disclosure for Legal Purposes
Further, the Academy may disclose Users’ Personal Information if required by law or a valid court order. The Academy may also share and communicate Personal Information to comply and ensure compliance with applicable laws and policies. Moreover, the Academy may use Users’ Personal Information if the Users violate, or attempt to violate, any policies established by the Academy, such as the Terms and Conditions.

The Academy may use Users’ Personal Information to provide them with personalized offers, customized experiences and content based on interests and saved preferences.
The Academy may also use Personal Information and Non-Personal Information to inform Users about Courses, Modules and offerings on the Website that may be of interest. The Academy may send Users marketing and promotional materials via email.

The Academy may use Non-Personal Information collected from the Website to evaluate the efficiency of Courses and Modules offered and provided on the Learning Management System.
The Academy may also aggregate Non-Personal Information to assess and analyze Users’ usage patterns on the Website. Furthermore, such Non-Personal Information may be used by the Academy to compare individual User activity with that of other Users.
5.7 Fraud Prevention
Personal Information and Non-Personal Information may be used to maintain the integrity and security of User data, protecting such data from fraud and unauthorized use. In this regard, the Academy shall be permitted to use information collected from the Website to detect, investigate, and prevent fraudulent transactions or other illegal activities. Additionally, the Academy may use such information to safeguard its rights and property, as well as those of others and to enforce its policies.
5.8 Student Reviews
By submitting one (1) or more reviews on the Website, Users agree that their reviews may be publicly shared and published on the Website. Such reviews may include feedback and comments regarding the Courses and/or Modules completed. The name and designation (if applicable) of the User who shared the review shall be published in connection with the review. However, other personal identifiers, such as contact information, shall not be published as part of the review unless explicitly specified by the Academy.
5.8 Users’ Consent
The Academy shall not sell, trade, rent or otherwise share Users’ Personal Information with third parties except with Users’ prior consent. Notwithstanding the foregoing, the Academy may share Users’ Personal Information with third-party service providers who perform services for the Academy in connection with the Website. The Academy shall have the limited right to share Personal and Non-Personal Information with authorized third-party service providers to allow them to perform duties that the Academy has delegated or subcontracted to them, which may include processing payments and granting access to the Learning Management System.
The third-party service providers engaged by the Academy shall only collect, use, and disclose Personal Information as is necessary to perform the services they provide for the Academy in connection with the Website.
In accordance with applicable laws, the Academy shall not use additional categories of Personal Information for purposes beyond those permitted by this Privacy Policy, unless Users have provided their prior written consent or have been granted sufficient and formal notice.
- SAFEGUARDING PERSONAL INFORMATION
The Academy has implemented reasonable precautions and follows industry practices to safeguard Personal Information from unauthorized access and disclosure. Users may contribute to helping protect their Personal Information by selecting a hard password, and logging out of User Accounts on the Website when using a shared device.
The Academy takes necessary precautions, at all times, to protect and safeguard Personal Information from unauthorized disclosure, damages or other breaches. Personal Information shall be protected by SSL certificates and reCAPTCHA and other protections granted.
While these measures are designed to protect Personal Information, they cannot guarantee that Personal Information shall never be accessed, disclosed, altered, or destroyed unlawfully. By using the Website, Users acknowledge and accept the risks associated with transmitting information online.
- RIGHTS GRANTED TO USERS

7.4 Right to Erasure
Users may not delete their User Accounts directly on the Website. Instead, the Academy may delete User Accounts upon request or at its discretion, in compliance with the Terms and Conditions.
Accordingly, Users affected by the processing of Personal Information shall have the right to require the immediate deletion of their User Accounts and corresponding Personal Information at their discretion. Users may request the deletion of their Personal Information from the Academy’s servers. Any such requests may be provided to the Academy by email, and shall provide justification to support such request. The Academy may refuse to honor such requests if required by law or if the retention of the information is necessary for legitimate business purposes, as specified in the Privacy Policy.
7.5 Exercise of Rights
To exercise any of the rights granted under this Privacy Policy or applicable laws, Users may send an email to the Academy. Any such request transmitted by email shall clearly identify the User to enable verification of their identity. Further, the request shall specify the Personal Information being requested and provide justification for the request.
If the request is valid, the Academy shall fulfill it accordingly. The Academy may use Users’ Personal Information to confirm the identity of the Users and process the request. The Academy reserves the right to refuse a request if the Academy deems it to be unfounded or non-compliant with the terms of this Policy.

The Website is not designed for minors, and the Academy shall not intentionally collect or target Personal Information from individuals under the age of eighteen (18). Users under the age of eighteen (18) are advised not to use the Website.

As required for internal business purposes, Personal Information and purchase receipts shall be kept on file for seven (7) years, unless otherwise provided by the Academy. The Academy shall never share Personal Information on social media or for advertising purposes.
In addition, the Academy may hold Personal Information in its servers for payment purposes until all sums owed have been paid or to resolve disputes. Further, Users’ usernames and passwords on the Website and the Learning Management System shall be safeguarded for one (1) year and destroyed thereafter. All such Personal Information shall be saved and maintained on a secured third-party server.
Once the Academy has removed Users’ Personal Information from its servers, the Academy may maintain Non-Personal Information on its servers, indefinitely, for analytical and statistical purposes.
In accordance with applicable laws, the Academy shall destroy Personal Information for confidentiality purposes or once the information is no longer needed. In compliance with applicable laws, rather than delete information collected from the Website, the Academy shall be permitted to anonymize such Personal Information.
- LINKS TO THIRD PARTY SITES
The Website may contain links to or be compatible with third-party sites, websites, or applications. This Privacy Policy shall not apply to third-party sites linked on the Website. The privacy policy of each third-party site shall govern use and access to the third-party sites.
The Academy shall not be responsible for the privacy practices of any third-party sites linked on the Website. This Privacy Policy shall apply exclusively to the Personal Information collected by the Academy on the Website.
